European Association for Aquatic Mammals Electronic Communication Terms and Conditions of Use – Updated July 2011
1. ACCEPTANCE OF TERMS
This agreement (“Agreement”) is between the European Association for Aquatic Mammals and its subsidiaries and affiliated entities (collectively, “EAAM”, “we” or “ours”) and you and your agents (“you” or “yours”) for the use of EAAM Web site and electronic communications (“electronic communication”). This Agreement includes any guidelines or information posted and updated via electronic communication by EAAM from time to time.
2. DISCLAIMER OF WARRANTIES
The use of the electronic communication is solely at your own risk. The electronic communication is provided on an “as is” basis. EAAM expressly disclaims all warranties of any kind with respect to the electronic communication, whether express or implied. EAAM makes no warranty that the electronic communication and/or any content therein will meet your requirements, or will be timely, current, accurate, complete or error-free or that the results that may be obtained by the use of the electronic communication and/or any content therein will be accurate or reliable.
3. LIMITATION OF LIABILITY
You expressly understand and agree that EAAM shall not be liable for any direct, indirect, incidental , special, consequential, or exemplary damages resulted from the use or inability to use the electronic communication.
4. YOUR RESPONSIBILITIES
You further agree and acknowledge that you are solely responsible for the care and well-being of patients and any reliance on the electronic communication shall not diminish that responsibility. You are responsible for establishing such procedures, as you deem appropriate in your professional judgment to verify the accuracy of data transmitted hereunder. You acknowledge and agree that by providing the electronic communication hereunder, EAAM is not rendering medical or other health care services or engaged in the practice of medicine, including veterinary medicine, and shall not be liable to any party for any act or failure to act relating thereto, in addition to any limitation of liability provisions contained in this Agreement.
You agree to defend, indemnify and hold EAAM, its subsidiaries, affiliates, officers, directors, employees and agents, harmless from and against any third party claim, action or demand (“Claim”) and all liabilities and settlements related thereto, including without limitation, reasonable legal and accounting fees, resulting from, or alleged to result from, your use of the electronic communication and/or its Content and/or User Content.
